Meeting of Rajasthan dharam Kanta representatives with Mr Ashutosh Agarwal, IAS to present views on keeping one ton weight at the weighbridge site

An order was released by Mr Anil Kumar, Controller, Rajasthan Legal Metrology on 11th June 2021. The order stated that in sub Rule 4 of Rule 21 of Rajasthan Legal Metrology( Enforcement) Rules 2011, it was specified that in case of more than one weighing instrument at the same user/address, it shall be sufficient for the user/firm to keep duly verified and stamped weights of one tonne or equal to one-tenth of the capacity of the weighing instrument (instrument with the highest capacity), whichever is less. Such user/firm is not required to have separate verified and stamped weights for each weighing instrument.

The letter also mentioned that according to the provisions of Rajasthan Legal Metrology (Enforcement) Rules 2011, users must keep one tonne duly verified and stamp weights or equal to one-tenth of the capacity of the instrument, whichever is less. Further, Director, Legal Metrology, New Delhi has advised ensuring the compliance of the said rule in the interest of industries.

The order gave rise to various kinds of concerns. Since it is not economically feasible for small or young establishments to possess/ invest in weights that might lock in their capital, Mr Sushil Aggarwal and owners of different weighing stations in Rajasthan put forth their stance before IAS and controller, Mr Ashutosh Aggarwal, stating and representing the key concerns. The meeting took place on August 3, 2021, around 7 pm.

A plea was made to replace one tonne of verified weights with two to three quintiles of weight in the order. The participants claim that it was very humble of Mr Ashutosh to take out time from his busy schedule for this meeting and that he was very empathetic towards their problems and they are very satisfied with the way the meeting went. Both sides got a fair chance to present their perspective towards the aforementioned order. Mr Sushil Aggarwal was accompanied by Mr Ravi Sethi, Mr Pradeep Singhal, Mr Om Prakash Basheen and Mr Suresh. A positive response is expected at the earliest.

 

श्री अनिल कुमार, नियंत्रक, राजस्थान विधि माप विज्ञान ने 11 जून 2021 को एक आदेश जारी किया गया था। आदेश में कहा गया है कि राजस्थान कानूनी माप विज्ञान (प्रवर्तन) नियम 2011 के नियम 21 के उप नियम 4 में, यह निर्दिष्ट किया गया था कि एक से अधिक वजनकंटे के एक ही उपयोगकर्ता/पते पर उपकरण होना , उपयोगकर्ता/फर्म के लिए एक टन या वजन उपकरण की क्षमता के दसवें हिस्से के बराबर (उच्चतम क्षमता वाला उपकरण) विधिवत सत्यापित और मुद्रांकित वजन रखने के लिए पर्याप्त होगा । ऐसे उपयोगकर्ता/फर्म को प्रत्येक तौल उपकरण के लिए अलग से सत्यापित और मुद्रांकित बाट रखने की आवश्यकता नहीं है।

पत्र में यह भी उल्लेख किया गया है कि राजस्थान कानूनी माप विज्ञान (प्रवर्तन) नियम 2011 के प्रावधानों के अनुसार, उपयोगकर्ताओं के लिए एक टन विधिवत सत्यापित और स्टाम्प वजन या उपकरण की क्षमता के दसवें हिस्से के बराबर, जो भी कम हो, रखना अनिवार्य है। इसके अलावा, निदेशक, कानूनी माप विज्ञान, नई दिल्ली ने उद्योगों के हित में उक्त नियम का अनुपालन सुनिश्चित करने की सलाह दी है।

आदेश विभिन्न प्रकार की चिंताए सामने लाया । छोटे या युवा प्रतिष्ठानों के लिए यह आर्थिक रूप से व्यवहार्य नहीं है कि वे एक टन के बाट खरीद के अलग रख सके , श्री सुशील अग्रवाल और राजस्थान के विभिन्न वजन स्टेशनों के मालिकों ने आईएएस और नियंत्रक श्री आशुतोष अग्रवाल, के सामने अपना रुख रखा। बैठक 3 अगस्त 2021 को शाम करीब 7 बजे हुई।

आदेश द्वारा एक टन सत्यापित वजन को दो से तीन क्विंटल वजन से बदलने की मांग की गई । प्रतिभागियों का कहना है कि इस बैठक के लिए अपने व्यस्त कार्यक्रम से समय निकालना श्री आशुतोष का बहुत आभार है और उन्होंने उनकी समस्याओं के प्रति बहुत सहानुभूति राखी।  दोनों पक्षों को उपरोक्त आदेश के प्रति अपना दृष्टिकोण प्रस्तुत करने का उचित अवसर मिला। श्री सुशील अग्रवाल के साथ श्री रवि सेठी, श्री प्रदीप सिंघल, श्री ओम प्रकाश बशीन और श्री सुरेश भी थे। जल्द से जल्द सकारात्मक प्रतिक्रिया की उम्मीद है।
